User Agreement of the Lu4 Test Website
The online platform Lu4 Test, accessible at https://lu4-test.org/, provides information about video games, their developers, and the latest news from the gaming world.
Access to and use of this Website is permitted only upon full and unconditional acceptance of the terms of this User Agreement.
Any User who fully or partly disagrees with these terms must immediately stop using the Website.
1. Terms and Definitions
For the purposes of this User Agreement, the following terms carry the meanings set out below:
Website Administration — holds all exclusive proprietary rights to the Website (including its domain name) and all materials published on it, and is responsible for its administration and management.
Database — the body of Information published on the Website. All Information on the Website, including its selection, organisation, and arrangement, constitutes the intellectual property of the Website Administration and/or other rights holders.
Information — any content posted by the User or the Website Administration, including: Personal Information, links to third-party sites, text posts, game reviews, comments, images, audio/video works, software, and other files.
Moderation — editing or removing any Information present on the Website, including content added by Users.
User — any individual who accesses the Website. A User who has completed registration and received login credentials is a registered User with a Profile. Any User accessing the Website automatically agrees to this User Agreement.
User-generated content — any content (text, video, images, reviews, feedback, comments, etc.) created and posted by Users on the Website.
Profile (account) — a password-protected section of the Website containing information provided by the User. Each User is entitled to one Profile only.
Personal Information — any data voluntarily provided by the User during registration or use of the Website, including personal details and data automatically transmitted during use, such as IP address, cookies, browser data, and other device-related information.
Website — the online resource at https://lu4-test.org/. Depending on context, this may also refer to the Website's software, design, database, any section or subsection, and information posted by the Website Administration and Users. All proprietary rights belong to the Website Administration.
Spam — unsolicited advertising, informational, or promotional communications.
Any terms not defined in this section shall be interpreted according to their plain meaning as derived from this Agreement. In cases of ambiguity, the interpretation of the Website Administration shall prevail.
2. Subject Matter and General Provisions
This User Agreement (hereinafter the "Agreement" or "Rules") sets out the terms and conditions for using the Website and posting Information on it, and constitutes a binding contract between the User and the Website Administration, superseding all prior agreements between the parties.
Accessing or using the Website, or performing any other actions on it, signifies the User's acceptance of and agreement to comply with all terms of this Agreement. Completing the registration procedure on the Website also constitutes acceptance of this Agreement.
The Website Administration reserves the right, at any time and for any reason, without prior notice or obligation, to:
Restrict, limit, or terminate Users' access to the Website;
Decline, on any grounds, to publish, move, or remove any materials on the Website;
Suspend or delete User accounts, and remove or erase any information contained in User account files.
By accepting this User Agreement, the User acknowledges that the Website Administration bears no liability to the User or any third party for carrying out any of the actions described in this Agreement.
The User understands and agrees that use of the Website may be accompanied by advertisements, and that such advertising is necessary for the Website's operation. The User agrees not to block, alter, or restrict the display of advertisements by modifying HTML/CSS or by any other means. By using the Website, the User acknowledges the Website Administration's right to display advertisements without prior notice and without any compensation to the User. The nature and volume of advertisements are determined and may be changed at the sole discretion of the Website Administration.
Any correspondence, dealings, or participation in promotions conducted by advertisers — including payment and delivery of goods or services, and any terms, conditions, warranties, or representations associated with such dealings — are solely between the User and the advertiser. The User agrees that the Website Administration is not responsible or liable for any losses or damages arising from such dealings or from the presence of advertisements on the Website.
3. Registration
To access all features of the Website, the User must complete the registration process. Registration involves completing an electronic registration form, after which the individual becomes a registered User and receives a unique login and password to access all available features of the Website.
The Website Administration reserves the right to suspend and/or delete a User's Profile, deny access to all or certain features of the Website, and remove User Information without explanation. This includes, but is not limited to, cases where the User violates this Agreement, provides false information, or where the Website Administration has reason to believe that the information provided is inaccurate, incomplete, or misleading.
4. Authorisation
Each registered User has a unique login and password required to access the Website. These credentials are intended solely for use by the registered User.
The User agrees not to share or transfer their login and password to any third party and must take all reasonable steps to keep their credentials secure. Login credentials grant access to sections of the Website available only to registered Users, as well as to personal pages intended solely for that User.
If any person other than the User accesses the Website using the User's credentials, all actions performed by such person shall be deemed to have been performed by the User. The User is solely responsible for all actions taken on the Website by themselves and by any third party using their login and password.
The registered User is solely responsible for maintaining the confidentiality and security of their login and password and for all consequences arising from any unauthorised or improper use thereof.
In the event of unauthorised use of their credentials, or suspicion thereof, as well as any actual or suspected breach of account security, the User must immediately notify the Website Administration.
The Website Administration is not liable for any potential loss or corruption of Information resulting from the User's breach of this section of the Agreement.
5. User's Personal Information
When processing the User's Personal Information, the Website Administration undertakes to implement all organisational and technical measures necessary to protect it from unlawful or accidental access, destruction, alteration, blocking, copying, distribution, or other unlawful actions by third parties. However, it cannot be excluded that, due to a technical fault, virus or cyberattack, or other circumstances, Personal Information may become accessible to third parties. The User understands this and agrees not to bring any claims against the Website Administration in this regard.
Although the Website Administration requires only a minimum amount of information during registration, the User may, at their own discretion, add further personal data. The User agrees that any Personal Information provided in their Profile is publicly accessible and may be viewed by other Users of the Website.
The User agrees that the Website Administration collects, stores, and otherwise processes the User's Personal Information for the following purposes:
Identifying the party within the framework of agreements and contracts with the Website Administration;
Sending notifications, messages, and information related to the use of the Website;
Communicating with the User to provide services and to handle requests and enquiries from the User;
Improving the quality and usability of the Website, and developing new services and features;
Targeting advertising materials;
Conducting statistical and other research based on anonymised User data.
The User confirms that, by posting their Personal Information on the Website, they do so voluntarily and consent to its processing by the Website Administration, including its transfer and processing in accordance with applicable law. If the User does not wish their personal data to be processed, they should refrain from providing it on the Website.
The User undertakes not to post the personal data of third parties on the Website without their consent, and not to use the personal data of other Users in any manner inconsistent with applicable law or with the intended purpose of the Website.
The User has the right at any time to update or supplement their Personal Information, provided such changes do not violate the terms of this Agreement.
The User may request deletion of their Personal Information by contacting the Website Administration via the Feedback form. This may limit the User's access to certain features and sections of the Website.
The Website Administration shall not be liable for the use of the User's Personal Information by third parties, including those to whom such information was transferred by the Website Administration in accordance with clause 5.9 of this Agreement.
Without prejudice to other provisions of this Agreement, the Website Administration may transfer the User's Personal Information to third parties in the following cases:
The User has given explicit consent to such transfer;
The transfer is necessary for the User's use of the Website or for the provision of services to the User;
The transfer is required under applicable legal or regulatory procedures;
The transfer occurs in connection with the sale or other transfer of the business (in whole or in part), whereby all obligations under this Agreement regarding the User's Personal Information are assumed by the acquirer;
To protect the rights and legitimate interests of the Website Administration or third parties where the User has violated the terms of this Agreement;
The transfer occurs between entities affiliated with the Website Administration, in which case all obligations under this Agreement regarding the User's Personal Information are also assumed by the recipient.

6. Content Posting
6.1. The User agrees that they bear sole responsibility for any materials publicly posted or confidentially transmitted on the Website. By accepting these Rules, the User confirms that they hold all necessary intellectual property rights to the User Content and grants the Company the right to use, copy, create derivative works from, distribute, publicly display and perform, store, transmit, and publish the User Content and any subsequent edits for the following purposes:
(i) displaying the User Content on the Website;
(ii) distributing the User Content electronically or by other means to enable other users to download or access such content;
(iii) storing the User Content in a remote database accessible by other users.
If the User does not hold the appropriate rights to post any Information on the Website, they agree not to post such Information.
6.2. When using the Website, Users may encounter content that is harmful, offensive, obscene, or inaccurate. The User accepts all risks associated with the use of such content. The Website Administration reserves the right to remove content that violates this User Agreement or is otherwise offensive, but does not assume any obligation to do so.
6.3. When using the Website, the User agrees to:
Refrain from any actions that may disrupt the proper functioning of the Website.
Not post or transmit via the Website any Information that:
contains threats, defamation, or abuse;
discredits the honour and/or dignity of third parties;
violates the rights and legally protected interests of third parties, including intellectual property rights;
infringes individuals' right to privacy or disrupts public order;
promotes or contains discrimination based on race, ethnicity, gender, age, religion, social status, sexual orientation, political views, or other grounds;
incites or advocates for the overthrow of the constitutional order, war, religious, racial, or ethnic hatred, or the infringement of minority rights;
promotes hostility or incites violence;
contains pornographic or otherwise indecent material;
contains extremist material;
offends religious sensibilities;
is knowingly false or misleading;
is intended solely to generate traffic to external websites;
includes links to full game versions or unauthorised beta releases.
Not deliberately flood sections of the Website with useless or non-informative messages, repeated characters, identical posts, oversized images or special characters, excessive formatting (e.g. Caps Lock, transliteration), or any other methods that disturb other users or distort the Website layout.
Not post commissioned content created in someone's interest that contradicts the purpose of the Website.
Not post any Information that violates applicable laws and/or this Agreement.
Refrain from publicly criticising the Administration (including moderators acting as its representatives), questioning moderation or administration decisions, or arguing with moderators or administrators.
Not post or distribute malicious software (viruses, trojans, worms, etc.) or any files, codes, or programs designed to disrupt, modify, block, destroy, or limit the functionality of any computer or telecommunications equipment or software, or that enable unauthorised access.
Not deploy or use bots, crawlers, or other automated systems to extract, transfer, copy, block, modify, or destroy Information or Databases, or to circumvent restrictions imposed by the Website Administration.
Not post any advertising materials without prior written consent from the Website Administration.
Not post or use any Information protected by intellectual property law (including patents, trademarks, and copyrights) without the appropriate rights or authorisation. In the event of a dispute, the burden of proof lies with the User.
Not collect, store, distribute, process, or otherwise use the Personal Information of other Users.
Not post links to websites that violate applicable laws and/or this Agreement.
Assess the legality of any materials (including images of others, third-party texts, audio, and video) before posting them on the Website.
Not distribute spam, chain letters, get-rich-quick schemes, pyramid schemes, multi-level marketing (MLM), or email-business systems.
Not facilitate or engage in any unlawful activity using the Website, or act in any manner that contradicts applicable laws and/or this Agreement.
Not post content aimed at extorting or soliciting money from other Users or third parties for any reason.
The Website Administration does not verify, nor has the technical or practical ability to verify, all Information posted by Users for compliance with applicable laws and this Agreement. However, the Administration may carry out such checks at its sole discretion where concerns arise.
The Website Administration provides Users with the ability to post Information on the Website but assumes no responsibility for the accuracy or legality of such User-submitted Information.
Links to other websites, products, services, or commercial and non-commercial content posted by Users or displayed as advertising on the Website do not constitute endorsement or recommendation by the Website Administration.
The Website Administration reserves the right, at its sole discretion, to reject or remove any Information that the User intends to post or has already posted on the Website.
7. Use of the Website
The User may use the Website only in accordance with this Agreement and solely in the ways permitted by the technical capabilities of the Website.
The Website may contain links to third-party websites, which may be of a commercial nature. The inclusion of third-party content or links on the Website does not constitute an endorsement of such content or websites. The Website Administration is not responsible for the content of third-party websites or any content hosted on them, nor for any goods or services offered via such links.
Any interaction with third parties, including transactions involving payment, delivery of goods, or provision of services, is conducted by the User independently. The Website Administration bears no responsibility and assumes no obligations in the event of any loss or damage arising from such transactions. Any questions, legal claims, or complaints regarding goods or services must be directed to the relevant vendor.
8. Liability
The Website Administration makes commercially reasonable efforts to ensure the Website operates on a 24/7 basis; however, it does not guarantee the absence of interruptions related to technical faults, maintenance, or partial unavailability of the Website or its services.
The User agrees to indemnify, defend, and hold harmless the Website Administration and all of its officers, directors, owners, employees, agents, information providers, affiliated companies, partners, and licensors (collectively the "Partners") from and against any liability, damage, expense, or cost (including legal fees) incurred in connection with any claim, including but not limited to claims for defamation, violation of publicity rights, invasion of privacy, or intellectual property infringement, arising from:
the use of the Website;
any use or alleged use of the User's account and password by any person, whether or not authorised by the User;
the content, quality, or nature of materials posted by the User on the Website;
the User's breach of this Agreement or violation of the rights of any third party, whether an individual or a legal entity.
The Website Administration does not guarantee that information posted on the Website will be available at all times or will not be deleted or lost. The Website Administration shall not be held liable for any failures or delays in the operation of the Website or for any consequences arising from such failures or delays.
The Website Administration is not responsible for offensive, knowingly false, misleading, or otherwise unlawful information posted by third parties. However, the Website Administration undertakes all reasonable efforts to remove such information upon receiving a complaint from rights holders or Users. Responsibility for such content lies with those who posted it.
All information published on the Website, including its layout and design, is provided "as is." The Website Administration makes no warranties that the Website is or will be suitable for any specific purpose.
In the event that third parties bring claims against the Website Administration in connection with the User's use of the Website, the User agrees to independently resolve such claims and hold the Website Administration harmless from any resulting losses or legal proceedings.
9. Miscellaneous
This Agreement shall be governed by and construed in accordance with applicable legislation. Any matters not addressed by this Agreement shall be resolved in accordance with applicable law. All disputes arising from relationships governed by this Agreement shall be resolved as prescribed by applicable legislation.
The User and the Website Administration shall make every effort to resolve any disputes through negotiation. If the parties are unable to reach a resolution through negotiation, such disputes shall be referred to the competent court.
Nothing in this Agreement shall be construed as establishing agency, joint venture, employment, or any other relationship not expressly provided for herein between the User and the Website Administration.
If any provision of this Agreement is found by a court to be invalid or unenforceable, such finding shall not affect the validity or enforceability of the remaining provisions.
This Agreement is the definitive version governing the relationship between the User and the Website Administration. In the event of any discrepancy between versions provided in different languages, the version designated as authoritative by the Website Administration shall prevail.
If the Website Administration fails to act in response to a breach of this Agreement by the User or other Users, this shall not be deemed a waiver of its right to take appropriate action in the future. Such inaction does not waive the Website Administration's right to respond to similar or repeated violations.
This Agreement may be amended by the Website Administration at any time without specific prior notice. The updated version shall take effect upon its publication on the Website, unless otherwise specified. Continued use of the Website after the updated Agreement takes effect constitutes the User's acceptance of the changes. If the User is no longer able to comply with the terms of the Agreement, they must immediately stop using the Website.
The Website Administration may also impose restrictions on certain features or services, or limit the User's access to the Website or parts of it without prior notice and without liability, for technical or security reasons, to prevent unauthorised access or data loss, or where the Website Administration reasonably believes the User is violating this Agreement or any applicable law.

This Agreement constitutes a public offer. The User's acceptance of its terms is demonstrated by their actual use of the Website, its services, and any information published on it.
If you believe your intellectual property (such as images, texts, or other content) has been unlawfully published on the Website, please contact the Website Administration to resolve the matter by completing the appropriate Feedback form.
